Status: CONDITIONAL - DO NOT CLAIM DMCA §512 SAFE HARBOUR UNTIL AGENT REGISTRATION IS COMPLETE.
TCM respects copyright and responds to sufficiently specific infringement reports under applicable law.
1. Copyright report
Send to /legal/report/?category=copyright:
- identification of the copyrighted work;
- identification and location/URL/TCM ID of the material complained of;
- contact information;
- a good-faith statement that the disputed use is not authorised by the owner, agent or law;
- a statement, under penalty of perjury where required, that the notice is accurate and you are authorised to act;
- physical/electronic signature where the DMCA applies.
2. U.S. designated agent
To seek 17 U.S.C. §512 safe-harbour protection, a qualifying service provider must designate an agent with the U.S. Copyright Office and keep public agent information current. [S18]
Before TCM publishes “DMCA agent” or “DMCA safe harbour,” complete:
- Copyright Office electronic agent registration;
- public agent details on TCM;
- repeat-infringer policy appropriate to the service;
- operational notice/counter-notice workflow;
- recordkeeping and restoration process.
Designated agent: Not published — registration evidence has not been provided.
3. Counter-notice
If U.S. DMCA counter-notice rules apply, TCM will provide a compliant counter-notice route and follow the statutory restoration timetable unless the complainant initiates qualifying court action. Final U.S. counsel review is required before enabling this workflow.
4. Other jurisdictions
A DMCA notice is not the only rights mechanism. EU/EEA users may use the DSA illegal-content report process and applicable copyright law.
