REPORT / ILLEGAL CONTENT / TAKEDOWN POLICY (DSA-READY)

TCM provides an electronic channel to report a specific item of content that you believe is illegal or violates the Content Rules.

1. Where to report

For DSA purposes, TCM should publish:

• accepted languages: Romanian and English at minimum. [S7]

2. What a notice should contain

To enable a precise, substantiated assessment, provide:

• category: illegal content / threat / harassment / hate / personal information / impersonation / intimate content / copyright / spam / other;
• exact URL and, if visible, TCM ID;
• a sufficiently substantiated explanation of why the information is illegal or violates the rules;
• legal basis if known (not mandatory for ordinary users who cannot identify a statute);
• your name and email, except where law permits/mandates an exception;
• supporting evidence necessary to understand the complaint, avoiding unnecessary sensitive material;
• a good-faith statement that the information in the notice is accurate to the best of your knowledge.

3. What TCM does

Where DSA Article 16 applies, TCM will:

1. acknowledge receipt without undue delay if electronic contact details are supplied;
2. process the notice in a timely, diligent, non-arbitrary and objective manner;
3. decide whether to remove/restrict, seek more information, or take no action;
4. inform the notifier of the decision and available redress where required;
5. provide the affected user a statement of reasons where Article 17 applies. [S7]

4. Statement of reasons

The reason notice should record at least: action taken; territorial scope/duration if relevant; facts/circumstances relied upon and whether a notice triggered the decision; whether automated means were used; legal ground if illegality is found; contractual ground if Terms/Content Rules are applied; and redress options. 5. Urgent safety reports

For imminent threats to life/safety, use /legal/report/?category=threat and contact local emergency/law-enforcement services directly where appropriate. TCM is not an emergency service.

When TCM becomes aware of information raising suspicion of a criminal offence involving a threat to life or safety, DSA Article 18 may require prompt notification to relevant law-enforcement/judicial authorities. [S7]

7. DSA scope note for launch

SPOTLIGHT stores sender information and disseminates approved user information to the public. On that architecture, it is prudent to treat TCM as potentially within DSA hosting/online-platform definitions pending counsel confirmation. PRIVATE does not publicly disseminate to an unlimited audience, but its hosting function can still engage hosting-service duties. This is a legal classification to confirm, not a final regulatory determination.

8. ANCOM notification

If TCM is an intermediary-service provider established in Romania within Law 50/2024, the Operator must send the required information to ANCOM within 45 days from starting to offer the services. Prepare the filing before go-live and calendar the statutory deadline. [S8]
